Letter to the Ontario Minister of Labour‏

Dear Mr. Flynn,
                           In 2005 the Ontario enacted Bill 211 crafted by your government.  It abolished mandatory retirement at age 65.  The premise for this was compliance with the Ontario Human Rights Code.   In doing so your government exempted the WSIB from the application of this legislation.  Due to this the WSIB was able to continue to deny loss of earnings benefits to workers 65 years of age or older.  I believe this is clearly discriminatory.
       I am especially concerned about this because the number of workers employed in our workplaces who are 65 years of age or older is growing. They are at least as likely to get injured on the job or be afflicted with an occupational disease but are legally denied the same WSIB benefits as workers under the age of 65.  I believe this can`t be justified and I wish to know your thoughts on this matter.
       In the meantime I am encouraging workers 65 years of age or older who are denied WSIB loss of earnings benefits due to their age to appeal their denial  I intend to pursue their appeals to the WSIAT citing the Ontario Human Rights Code in support of them.
